Lawyer Failed to Advise Client of Settlement Offer
Obtained a confidential settlement on behalf of a client against his former attorney in connection with the mishandling of a lawsuit against the client. The client was sued by one of his employees and his lawyer failed to properly handle the defense of the case and failed to properly advise the client regarding settlement of the lawsuit. As a result, the employee obtained a judgment against the client. Following this adverse result, we pursued a claim against the client’s lawyer and obtained a confidential settlement from the lawyer’s insurance company.
National Law Firm Mishandled Judicial Foreclosure
Represented a bank against a national law firm which mishandled a judicial foreclosure lawsuit involving property valued in excess of $2 million dollars. As a result of the law firm’s negligence at trial, the bank was unable to foreclose on the property. After losing the trial, the law firm failed to timely file an appeal. The legal malpractice case settled before trial for a confidential amount.
Lawyer Mishandled Divorce and Overcharged Client
Represented a client against lawyers who mishandled her divorce and also overcharged the client for their legal services. One lawyer failed to conduct adequate discovery during the divorce proceeding and another lawyer missed a filing deadline and also overcharged the client for his services. The first lawyer settled before trial for a confidential amount and the case proceeded to trial against the second lawyer. The jury found that the second lawyer was negligent in missing the deadline and that he engaged in fraud by overcharging the client for his services. The jury awarded in excess of $100,000 in damages and attorneys’ fees.
Law Firm Failed to Designate Expert Witness
Represented a client against law firm who failed to properly designate an expert witness on attorneys’ fees in the underlying case. Although the law firm won the case, the client maintained that she was unable to collect approximately $500,000 in attorneys’ fees because the law firm failed to designate an expert witness to testify on attorneys’ fees. As a result, the jury did not award her attorneys’ fees in addition to her other damages in the case. After the legal malpractice lawsuit was filed, the law firm made a substantial settlement offer to the client, but the client refused the offer and the case went to trial. The jury found in favor of the law firm.
Law Firm Mishandled Mass Tort Lawsuit
Represented a client against a law firm that mishandled the client’s wrongful death lawsuit against a pharmaceutical manufacturer. The law firm, which had filed numerous lawsuits against the pharmaceutical manufacturer, failed to comply with certain deadlines established by the court in the mass tort lawsuit. As a result, the client’s case was dismissed. The legal malpractice case was filed with the American Arbitration Association in accordance with an agreement between the law firm and the client. The case settled for a confidential amount prior to arbitration.
Law Firm Mishandled Administrative Proceeding
Represented a client against a law firm which mishandled an administrative proceeding on behalf of the client. The client, a former police officer, was suspended from his employment, but he had a right to appeal his suspension based upon the civil service commission rules and regulations. His attorney failed to timely file his appeal with the civil service board, so he was denied the right to contest his suspension. As a result, he was unable to obtain employment with other law enforcement agencies. The legal malpractice case settled before trial for a confidential amount.
Attorney Provided Faulty Advice
Represented an individual against an attorney who had provided the client with faulty advice in connection with licensing, copyright and trademark matters. As a result of the faulty advice, the client was sued for copyright and trademark infringement and lost her business which had just begun generating sales in excess of $1 million. The case settled before trial for a confidential amount.
Attorney Represented Client with Conflict of Interest
Represented an individual against an attorney who had a conflict of interest while representing the client. The lawyer represented 2 clients with conflicting claims over a limited sum of money. As a result of a conflict of interest and the lawyers’ negligent handling of her case, the client was unable to recover the full value of her claim. The case settled before trial with one of the lawyers for the amount of his insurance policy limits. The other lawyer (who did not have insurance) settled for a structured payout.
Attorney Mishandled Administrative Appeal
Represented a former Dallas City Marshal in a lawsuit against his attorney, who mishandled an administrative appeal on behalf of the client. The client was terminated from his employment by the City of Dallas, but he had the right to appeal his termination based upon the City of Dallas Personnel Rules and Regulations. The client’s attorney failed to appear at the administrative hearing and the client lost his right to pursue the appeal and contest his termination. The legal malpractice case settled before trial for a confidential amount.
